Legal agreement

Terms of Service

These terms govern access to BandSet, paid plans, band workspaces and user content.
Effective 2026-10-15

1. Agreement and operator

By creating an account or using BandSet, you enter into an agreement with VibeX and agree to these Terms and the Acceptable Use Policy. The Privacy Notice explains how personal data is handled and is not a waiver of your privacy rights.

BandSet is software for organising band work: setlists, gig schedules, member coordination, live synchronisation, internal requests, chat and performance notes. It is not offered as a store selling song lyrics, chord sheets or music rights. Content-storage and display tools support that workflow; their availability is not a promise of access to any particular work or catalogue.

You must be legally capable of entering this agreement. If you use BandSet for a band, orchestra or other organisation, you confirm that you are authorised to act for it and to invite its members.

2. Accounts and managed members

  • Provide accurate information and keep your login credentials confidential.
  • You are responsible for activity performed through your account until you report unauthorised access.
  • A Band-plan leader who creates or invites managed members confirms that they have permission to use those members' contact details and must deliver credentials securely.
  • Accounts may not be sold, transferred, shared outside the intended member, or used to evade plan limits.

3. Plans, payments and cancellation

Plan fees pay for software features, workspace capacity and account access, not for ownership of, or a licence to, third-party musical works. Song or entry limits describe how many records the software can store or display; they are not a number of songs sold or licensed with the plan. A subscription does not clear copyright, public-performance or other permissions for your use of content.

Free, Solo, Band and custom plans have the features and limits displayed before purchase. When Paddle checkout is enabled, Paddle acts as merchant of record and authorised reseller for those purchases. The final price, taxes, currency, renewal amount and applicable buyer terms are shown before payment. Subscriptions renew automatically until cancelled. Existing Stripe purchases remain managed through Stripe. Registration alone does not charge a payment method.

Monthly and annual billing are available where shown. Annual billing is charged upfront for a full year and renews annually. Its base catalog price is ten monthly prices, equivalent to a 16.67% saving rounded for display against twelve monthly payments. Taxes, other discounts and changes during a billing period are shown before confirmation. Changing the billing period requires confirmation of the amount due now and the new recurring amount.

Where an eligible Solo or Band offer is available, a verified Free account may choose an optional 14-day free trial through Paddle. A payment card is required to activate it; creating or verifying a Free account does not activate a trial or create a payment obligation. No base-plan fee is charged during the trial. Unless you cancel before the first payment date shown at checkout, Paddle automatically charges the displayed monthly or annual renewal price, with applicable taxes, and the subscription continues to renew until cancelled. You may cancel the trial through the subscription-management link in your profile or the Paddle portal before that first payment. Trial eligibility is checked before activation and a previous trial or subscription may make an account ineligible. Refund requests after a charge are separate from trial cancellation and follow the policy below.

Cancellation stops future renewals at the end of the current billing period. Submit a Paddle refund request within 14 calendar days of the payment date via paddle.net or the support link on your receipt. The Refund & Cancellation Policy, Paddle Buyer Terms and Paddle Refund Policy explain the process. BandSet adds no product-specific refund restrictions. Mandatory consumer rights remain unaffected.

4. User notes, content and sharing

Users can write, import and edit performance notes, cues, repertoire information and other material they are entitled to use. Notes may contain song lyrics, excerpts, chord symbols or arrangements. We use "notes" to describe their practical purpose, not to reclassify protected works: calling material notes, typing it manually or keeping it within a band does not by itself make the use lawful.

You retain the rights you actually hold in submitted content. Uploading, copying or editing another person's work does not transfer ownership to you or BandSet. Only to the extent that you are authorised, you grant BandSet a non-exclusive licence to host, process, display, copy and transmit the content as necessary to provide the selected service and sharing settings, within the territory and duration allowed by those rights. Do not choose sharing settings that exceed your permission.

The global library is a shared-content area, not a sale or blanket licence of its contents. Sharing or submitting a note there, where available under your account permissions and the publication process, requires rights for access by users outside your band. A private copy, purchase from another service or permission to perform a song does not necessarily permit global sharing. Administrators who import or publish material must also have the necessary rights; administrative approval is not rights clearance.

Only within the rights you can grant and the sharing scope you select, you authorise permitted recipients to view and use your contribution through enabled app functions, including copying it into a band workspace or editing a working copy. This does not transfer copyright or grant a general right to republish, resell or use protected material elsewhere. Recipients must respect any applicable licence, attribution, territory and use restrictions. Do not upload or share material if you cannot authorise the uses enabled for it.

A band workspace is collaborative. Leaders and authorised members may edit, transpose, reorder, copy or remove shared songs and setlists. Keep an independent backup of material that is important to you.

Shared content may be restricted or removed for rights or safety reasons. Removal from a shared library does not guarantee deletion of copies already downloaded, printed or saved offline; users remain responsible for any continued use. Backup retention is described in the Privacy Notice. These technical limits do not reduce the operator's applicable legal duties.

5. Copyright and third-party rights

Anyone may report a suspected copyright infringement in a note at any time, including a person without a BandSet account. This is a request to review content, not a copyright registration or a transfer of ownership. A rights holder or representative making a claim must identify their rights and, where applicable, their authority to act. Other reporters should describe the concern without claiming to represent a rights holder.

Support reviews the identified note, the reported work and available evidence, and may request clarification or proof of permission from the reporter or contributor. Depending on the facts and applicable law, access may be restricted during review, the note may be removed, or it may remain available if removal is not warranted. A report does not automatically delete a note, and review does not delay action required by law. Sending a report at any time does not mean support is staffed around the clock.

  • Upload lyrics, chord sheets, recordings, names, images and other material only when you own it or have permission to use it.
  • Do not remove attribution or rights-management information or use the global library to distribute infringing copies.
  • BandSet may restrict or remove disputed material while a rights complaint is reviewed and may terminate repeat infringers. Action may also follow information obtained independently or a lawful authority request; the absence of a complaint does not establish permission or prevent enforcement.
  • A report should identify the original work, the disputed note, its location and the basis for the concern. Use the contact address below or the Copyright section in customer support.
  • Manual transcription, scraping, adding chords, transposition, attribution, non-commercial use or a subscription fee do not by themselves authorise reproduction or distribution of protected lyrics or arrangements. BandSet does not represent that all library material was handwritten, is original, or has a verified licence.
  • Entry credits identify the account that added or last edited a record using its chosen public name or abbreviated profile name; a band name may identify the workspace. They are not songwriter credits, a copyright registration or proof of permission. Do not use false names to impersonate a creator. Unknown historical contributions must not be invented.
  • Global submissions require rights covering the intended audience, territories and uses, including on-screen display and any enabled copying, adaptation, offline storage or printing. Keep evidence of permission. Public-domain claims must account for the applicable jurisdiction and any separately protected arrangement or edition. Access to a record does not by itself grant users permission for every use.
  • To report a rights issue, email admin@vibexofficial.com with the original work, the disputed record ID or URL, the rights holder, your authority to act, contact details, supporting references and an accurate explanation. The Copyright section in customer support opens an email draft; you must add the details and send it. No BandSet account is required to contact us by email. Do not include passwords or unrelated personal data.
  • Where reasonably possible and legally permitted, support explains its decision to the reporter and affected contributor. Either may request reconsideration by sending relevant evidence to admin@vibexofficial.com. An objection does not automatically restore a removed note. Support decisions concern access to the service, not a binding determination of copyright ownership; mandatory legal remedies and obligations remain unaffected.
  • These Terms allocate contractual responsibilities; they do not eliminate statutory liability, bind third-party rights holders, establish a general copyright exception or guarantee a hosting safe harbour.

6. Suspension, bans and termination

BandSet may remove content, limit features, suspend access, ban an account or terminate this agreement when there is a reasonable basis to believe that a user breached these Terms or the Acceptable Use Policy, infringed rights, endangered users or systems, engaged in fraud or payment abuse, evaded limits, failed to pay, created legal or security risk, or when action is required by law or a provider.

Urgent action may be immediate. Where reasonably possible, non-urgent enforcement will include notice or an opportunity to correct the issue. A user may ask for a review through the contact address below. BandSet may retain limited records when necessary for billing, security, fraud prevention, legal obligations or legal claims.

You may stop using BandSet at any time and may request verified account deletion. Deletion is subject to lawful retention duties and may remove personal workspaces and content that cannot be safely separated from the account.

7. Service operation and changes

BandSet may change, improve or discontinue features to maintain security, compliance and product quality. Material changes to paid service or these Terms will be communicated reasonably in advance when practicable. If a change materially disadvantages you, you may cancel before it takes effect where applicable law requires.

Realtime sync, offline storage, notifications, AI-assisted tools and third-party integrations depend on devices, connectivity and providers. They are not guaranteed to be uninterrupted or error-free and must not be the sole safety-critical record for a performance.

8. Disclaimers and liability

To the extent permitted by law, BandSet is provided as available without guarantees of uninterrupted availability, perfect accuracy or preservation of every item. You are responsible for checking musical content, permissions, schedules and backups before a performance.

To the extent permitted by law, BandSet is not liable for indirect, incidental or consequential loss, lost profits, lost performances or loss caused by user content, connectivity or third-party services. Aggregate liability is limited to the fees you paid for BandSet in the 12 months before the event giving rise to the claim. This limitation does not apply where exclusion is prohibited, including fraud, wilful misconduct, gross negligence, personal injury or mandatory consumer rights.

9. Governing law and contact

These Terms are governed by the laws of Republic of Serbia, without removing mandatory protections that apply in the user's country of residence. Courts and authorities remain available where applicable law requires.

Questions, legal notices, appeals and deletion requests may be sent to admin@vibexofficial.com. The current operator details are shown at the end of this page.
